Shipping, Customs Fees, Package Seizures and Loss

Products are shipped from our shipment warehouse in the United States directly to your address. All prices are in US dollars and do not include taxes and customs fees that may be due upon delivery of the parcel to your country outside the United States. Upon receiving your order, you may be asked to pay sales tax, value-added tax (VAT), or other duties or taxes by your local post office, subject to the regulations in your country. In the event additional fees are assessed to your order, your local Customs authority will contact you directly. All import duties, taxes and charges are the responsibility of the buyer. They are not included in the item price or shipping costs. Please contact your country’s customs office to confirm these additional costs prior to purchasing from Optimal Living Dynamics Inc. You cannot cancel your order or request a refund in the situation that you refuse to pay any extra charges. You agree to all the above listed policies upon ordering from Optimal Living Dynamics Inc.

After an order is placed, our shipment center immediately starts processing and shipping the order. Therefore, orders cannot be changed or cancelled once an order has been placed. If a customer requests to cancel their order, they must ship their order back to us after they receive it. To be eligible for a refund, customers must return their products to us. We cannot refund customers for items that are not returned to us.

International orders/shipments may be subject to the possible opening of packages and inspection of goods by customs officials in the country of delivery. Optimal Living Dynamics Inc. is responsible for shipping your order and providing full paperwork for customs in your country. Optimal Living Dynamics Inc. is not responsible and can't guarantee the processing and release of your order from Customs in countries outside the United States. Optimal Living Dynamics Inc. is not responsible for orders that are held up at customs, damaged by customs, or refused entrance by customs.

Each country has its own specific regulations regarding importing nutritional supplements. When ordering products from Optimal Living Dynamics Inc. to be shipped to a location outside the USA, you are considered the importer for that non-US country and must comply with all laws and regulations specific to your importing country. While Optimal Living Dynamics Inc. works hard to prevent products from shipping to countries where ingredients are problematic or prohibited, we cannot guarantee that our restriction information is always up to date. As these regulations change constantly, we strongly recommend that you check with your local authorities for information on regulations that may affect your ability to receive your order. To find out about customs regulations in your country, contact a local import broker in your area.

International orders are shipped by UPS. Optimal Living Dynamics Inc. is not responsible for any delays, loss, or damage to your parcel once it has been collected and transported by UPS. UPS delivers packages to the border of international countries. From there, the local postal service of each international country takes the package and delivers it the rest of the way. Delivery schedules vary globally, ranging from 2 to 6 weeks, and is subject to the local postal service.

International orders may take up to 60 days to clear customs and reach its final destination, depending upon government procedures. An international order will not be considered “lost” until 60 days after shipment date.

Overall, Optimal Living Dynamics Inc. cannot be held responsible for rejected parcels, seized products or delivery delays, nor any laws or regulations that result in Customs applying additional cost to your order, whether tax or duties.

However, the vast majority of international shipments do not experience problems or delays, and our customers are very rarely assessed additional fees. Although it is rare for international orders to be lost, please be aware that it can happen. We are not the delivery carrier and, therefore, are not responsible for undelivered packages that go missing internationally. We are unable to reship a package that is not received, as it is the responsibility of the delivery carrier to ensure that the package reaches you. Ultimately, lost packages are the fault of the shipping provider and we cannot assume the responsibility of replacing or refunding missing packages.

After our packages are shipped, it is the responsibility of the customer to open an investigation with their local postal service if the package is lost or stolen. You will have to file a loss/theft report with your local Postal Inspector Service, which can be very helpful in finding missing packages within the postal system due to theft/fraud/misdelivery. Many carriers now have scanners that are equipped with GPS tracking and the postal inspectors can find out exactly where the package is located, and they should be able to retrieve it and get it to you.

By ordering from Optimal Living Dynamics Inc., you agree to the policies stated above. Optimal Living Dynamics Inc. reserves the right to change these policies at any time, and we also retain the right to refuse service to any customer at our sole discretion.

Address Errors

We cannot change your delivery address after an order has been submitted. We work directly with our shippers to help resolve address issues where possible, but we cannot be held responsible for any delays, fees, or other delivery issues if your address was incorrectly entered at checkout. If such an error causes an order to be rejected, lost, or destroyed, we cannot issue a refund or replacement of any kind. If the error causes the order to be sent back to us, you may be responsible for return shipping fees, and we'll only be able to refund you for the cost of merchandise. If the return delivery cost is greater than the value of the merchandise, Optimal Living Dynamics Inc. will inform the carrier to abandon the package and no refund will be issued.

Violation of Laws

Items sold on The Website are intended for personal use. We ask that you please familiarize yourself with your country's import restrictions before ordering. We cannot be held responsible for any delays, fees, fines, or penalties incurred by your order due to a violation of law.

Customer Refusal

We are not able to offer refunds on products that are refused for any reason. In addition, if Optimal Living Dynamics Inc. is billed for the cost of the return shipment due to your refusal, you may be responsible for that cost, too.

Guaranteed Satisfaction/Return Policy

If you are unsatisfied with your product and ordered your product directly from our Website, you may return it within 60 days. You are responsible for the cost of the return postage. A copy of your invoice must be included with return as well as a reason for the return; please follow these simple procedures and you will be issued the appropriate credit. Please contact us for the return address at support@optimallivingdynamics.com.

If any package is returned to us due to an address error made by you, you refuse the package, or the items are not allowed into a certain country due to customs or otherwise, you will only be credited for the returned product less the cost of the entire shipping fee. If the product is unable to be returned or is destroyed, no credit will be issued.

Charges For Services

We may charge for access to portions of the products and services or to the products and services as a whole, and we reserve the right at any time to change the amount we charge for such access or subscriptions that include authorization to access the products and services. In such event, we will notify you in advance, and give you an opportunity to subscribe (or unsubscribe) to the products and service(s). More information about any such subscriptions can be found on the appropriate locations of the services. You shall pay all applicable taxes relating to use of the services, and recognize that any fees to third parties that may be required for you to receive the service (such as mobile data plans and text-message charges) are not included in the cost of the services.

Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Billing and Payment

Terms of payment are within our sole discretion, and unless otherwise agreed to by us, payment must be received by us prior to our acceptance of an order. Payment is due at the time of purchase and will be processed when authorized during the purchase process. Orders are not binding upon us, until accepted by us. We reserve the right to refuse and refund any order or part of any order placed on this website.

Your purchase of a product or service on this website may or may not qualify for any refund. Each specific product, service, event, or course will specify its own refund policy on the credit card form or on the terms and conditions associated with the products. Refunds may be granted at our discretion during the refund period only.

Accounts

Some services on the website permit or require you to create an account to participate and/or to secure additional features and/or benefits. You agree to provide, maintain and update true, accurate, current, and complete information about yourself as prompted by our registration processes. Warranty

Optimal Living Dynamics Inc. warrants that the Brain Photobiomodulation Therapy Lights will function and perform within the specifications for two years after the date of delivery. The 2 year warranty will cover all parts and labor during the warranty period with some exclusions. If required, the buyer is responsible for return shipping to Optimal Living Dynamics Inc. within the 2 year warranty period. The warranty shall not apply to any device that has been abused, misused, modified, damaged, or fitted with substitute parts other than parts originally manufactured . Optimal Living Dynamics Inc. shall not be liable for any consequential loss or inconvenience caused by any failure of an Optimal Living Dynamics Inc. product. After the warranty has concluded, the buyer is required to pay for all parts and labor charges. If the device is repaired or replaced, either within or outside the warranty period, Optimal Living Dynamics Inc. reserves the right to provide parts or replacement in different colors than the original device. Otherwise applicable sections of the Terms shall survive termination. In addition to any termination rights, we reserve the right to enforce and prosecute any violations of these Terms.

Supplemental Terms

In connection with your use of the product and services, you may be asked to consent to policies or terms and conditions in addition to these Terms. Please read these supplemental policies and terms carefully before making any use of such portions of the products or services. Any supplemental terms will not vary or replace these Terms regarding any use of the products and services, unless otherwise expressly stated.

No Waiver

The failure of Optimal Living Dynamics Inc. to enforce any provisions of the Terms or to respond to a breach by you or other parties shall not in any way waive its rights to enforce subsequently any terms or conditions of the Terms or to act with respect with similar breaches.

No Partnership

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Optimal Living Dynamics Inc. as a result of these Terms or your access to and use of the Services.

Entire Agreement

Unless otherwise specified herein, the Terms constitute the entire agreement between you and Optimal Living Dynamics Inc. and govern your use of the Services. If any portion of the Terms is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intention of the parties, and the remaining portions shall remain in full force and effect.

 

Refund Policy

If you would like to return an item to Optimal Living Dynamics Inc., you must contact us first. Items returned without prior contact may not be properly identified and this may either prolong or nullify your refund. Any items shipped to an improper address due to failure to contact us for return information is not our responsibility to refund or reship.

If you are unsatisfied for any reason, simply email our customer service at support@optimallivingdynamics.com, return your opened and unopened bottles, and we’ll refund your purchase, minus the cost of opened bottles, shipping/handling fees, and credit card processing fees. A restocking fee of $3.50 is applied to all returned orders. If you would like to receive a refund for any reason whatsoever, all you need to do is return your used and unused bottles to us within 60 days of placing your order. You can contact us and we will provide you with the return address as well as instructions. We will inspect returned products, which usually takes 1-2 business days, and then process your refund. We will refund the amount of the order minus the cost of opened/used bottles and the original shipping and handling fees. Returned product(s) will be fully inspected and evaluated before a refund is issued. Please follow exact directions provided by our customer service team in order for your refund to be received and processed appropriately and timely. You'll need to use a courier service that requires a signature to ensure that the parcel arrives safely. We cannot refund you for items that are not returned to us or are lost in the mail. The shipping costs to return the product is the responsibility of the buyer. Please note that we do not have a money back guarantee for Optimal Biotics because the nature of the product is non-returnable (bacteria).

If you would like to receive a refund for a purchased red light device or acupressure mat, simply email our customer service at support@optimallivingdynamics.com, return your light device or mat, and we’ll refund your purchase, minus the cost of shipping/handling fees. A restocking fee of $3.50 is applied to all returned orders. For light devices and acupressure mats, you will have to contact us within 7 days of receiving the device and return it within 30 days of your order. Red light devices and acupressure mats must be returned to our manufacturer for proper inspection to ensure the product hasn't been damaged or tampered with. You can contact us and we will provide you with the return address as well as instructions. Our manufacturer will inspect returned products, which usually takes 1-2 business days, and then process your refund. We will refund the amount of the order minus the cost of the original shipping and handling fees. Returned product(s) will be fully inspected and evaluated before a refund is issued. The device or mat must be in its original condition and packaging and include all components and accessories. Please follow exact directions provided by our customer service team in order for your refund to be received and processed appropriately and timely. If the device or mat is in your possession for more than 7 days, it’s considered used and we cannot issue you a refund or replacement. You'll need to use a courier service that requires a signature to ensure that the parcel arrives safely. We cannot refund you for items that are not returned to us or are lost in the mail. The shipping costs to return the product is the responsibility of the buyer.

This guarantee only applies to your first order. If you’re not satisfied and you return products for a refund, you cannot order them again and expect to get another refund. Before requesting a refund, you must have taken one full bottle of the product as suggested. Only one opened package of any product can be returned. All others of the same product must be in a factory-sealed container to be eligible for a refund. All returned items must be in their original packaging.

We will require the following from you when returning your product(s):

  • Your full name, address and order number

  • All used and unused items that were sent to you

  • Your reason for returning the products

  • Your shipping/tracking number

  • You must use a courier service that requires a signature. We recommend asking for a signature at delivery to prove that the parcel arrived safely. We cannot refund you for items that are not returned to us or are lost in the mail.

If you fail to comply with ALL of the above conditions we will not be obliged to give you a refund.

All additional services performed for a Customer or Client will be billed at our company rate of $200 per hour. Customers or Clients who choose to join The Brain Recovery Accelerator Program and authorize Optimal Living Dynamics Inc. to charge their credit card or debit card are subject to a non-refundable onboarding fee of $200 USD. The onboarding fee covers the cost of services rendered to onboard a new Client. SHIPMENTS

Unfortunately, due to both Customs regulations and shipping costs, Optimal Living Dynamics Inc. is not responsible for reshipping, replacing or refunding orders that are refused, lost, damaged, seized or destroyed by Customs. However, if Customs refuses a package, sends it back to us, and we receive it back from Customs, we can issue you a refund for the order only if we receive the package back at our fulfillment center and the contents are in an undamaged and resalable condition. The refund will be issued for the cost of the merchandise only; shipping costs cannot be reimbursed. In the event the package is not returned to us by Customs or is lost in transit, we cannot issue you a refund. We are not responsible for paying for the package to be returned to us or for reimbursing the customer for that cost. If Optimal Living Dynamics Inc. is billed for the cost of the return shipment due to restrictions, you may be responsible for that cost. If the cost to return a rejected package to our fulfillment center exceeds the value of the order, we'll instruct the courier to destroy the package and a refund will not be issued.

However, the vast majority of international shipments do not experience problems or delays, and our customers are very rarely assessed additional fees. Although it is rare for international orders to be lost, please be aware that it can happen. We are not the delivery carrier and, therefore, are not responsible for undelivered packages that go missing internationally. We are unable to reship a package that is not received, as it is the responsibility of the delivery carrier to ensure that the package reaches you. Ultimately, lost packages are the fault of the shipping provider and we cannot assume the responsibility of replacing or refunding missing packages.

We cannot change your delivery address after an order has been submitted. We work directly with our shippers to help resolve address issues where possible, but we cannot be held responsible for any delays, fees, or other delivery issues if your address was incorrectly entered at checkout. If such an error causes an order to be rejected, lost, or destroyed, we cannot issue a refund or replacement of any kind. If the error causes the order to be sent back to us, you may be responsible for return shipping fees, and we'll only be able to refund you for the cost of merchandise. If the return delivery cost is greater than the value of the merchandise, Optimal Living Dynamics Inc. will inform the carrier to abandon the package and no refund will be issued.

We are not able to offer refunds on products that are refused for any reason. In addition, if Optimal Living Dynamics Inc. is billed for the cost of the return shipment due to your refusal, you may be responsible for that cost, too.
